One of the purposes of the bankruptcy counseling and debtor education requirements was “anti-recidivist” in that it aims to reduce the likelihood of a bankruptcy debtor making a return visit to bankruptcy court.
After a bankruptcy case has been filed and before the bankruptcy court issues a discharge order, debtors are required to complete an approved course on consumer debt. These cases are often referred to as “providers or personal financial management instructional courses.” Upon completion of a U.S. Trustee-approved counseling and education programs, prospective debtors will be issued an authenticated certificate to file with the court.
These personal financial management courses usually cover the following:
- Development of a budget;
- Responsible use of credit; and
- Money management.
Like pre-bankruptcy credit counseling, these debtor education courses may be taken in person, over the telephone, or online. These classes usually take about two hours to complete and cost between $50 and $100, but the fee may be waived for debtors with qualifying circumstances.
