Our office handles cases both large and small. We regularly help people who owe smaller debts and appear in small claims court, we also regularly help people save homes and handled cases with the amount in dispute in the millions. We are pleased to report that we just won a credit card case for our client, a lawsuit for nearly a hundred thousand dollars.
A debt-buyer sued our client, a company whose business consists of buying old debts and then suing upon them. Most debt-buyer lawsuits are for smaller amounts but the fundamental legal principles are essentially the same regardless of how large the case is. Winning a debt collector lawsuit, as a creditor, is a bit like building a house. It has to be built one step at a time from the bottom up. First a foundation is poured. Then the walls are slowly put up, the roof and so on. To beat such a case you don’t need to tear down the entire house, you only need to tear out a wall, damage the foundation or otherwise break it enough that the entire thing falls down.
Despite the fact that our client was sued for nearly a hundred thousand dollars, the case contained the same fatal defects as other debt-buyer cases. We took down a supporting beam here or a floor tile there until they couldn’t build their case. Eventually the debt-buyer agreed to simply give up their case and leave our client alone.
