Consumer Beats Debt of Nearly a Hundred Thousand Dollars

A debt-buyer sued our client, a company whose business consists of buying old debts and then suing upon them. Most debt-buyer lawsuits are for smaller amounts but the fundamental legal principles are essentially the same regardless of how large the case is. Winning a debt collector lawsuit, as a creditor, is a bit like building a house. It has to be built one step at a time from the bottom up. First a foundation is poured. Then the walls are slowly put up, the roof and so on. To beat such a case you don’t need to tear down the entire house, you only need to tear out a wall, damage the foundation or otherwise break it enough that the entire thing falls down.

Despite the fact that our client was sued for nearly a hundred thousand dollars, the case contained the same fatal defects as other debt-buyer cases. We took down a supporting beam here or a floor tile there until they couldn’t build their case. Eventually the debt-buyer agreed to simply give up their case and leave our client alone.
