Have you been harassed by debt collectors using unethical or illegal tactics?
If so, you are not alone. According to the
Federal Trade Commission (FTC), Florida residents reported some of the highest numbers of complaints
regarding debt collectors, identity theft, and imposter scams during 2015.
Complaints about debt collectors in particular spiked during 2015. In 2014,
complaints about debt collectors made up only 17% of Florida’s complaints
to the FTC. In 2015, debt collection complaints made up more than half
of the state’s total.
For the fourth year in a row, Florida reported more complaints about debt
collectors than any other state in the country. On a per capita basis,
1,510 out of every 100,000 Floridians complained about debt collection
tactics, totaling over 300,000 complaints.
The FTC reported that these complaints included debt collectors who made
repeated or harassing phone calls, used foul or threatening language,
or attempted to collect debts that the person didn’t owe.
In response to these complaints, the FTC began ramping up enforcement efforts
against companies using illegal debt collection practices. The agency
led a federal, state, and local initiative called Operation Collection
Protection that resulted in over 130 agency actions. The FTC also permanently
banned 30 companies and individuals from the debt collection industry
and won almost $94 million in judgments against debt collectors.
While the FTC’s efforts will help consumers on a large scale, individuals
are still being harassed by debt collectors who fail to follow state and
federal laws. If a debt collector is bothering you with repeated calls,
threats, or calls to your boss or family members, then you may be able
to file a claim under the Fair Debt Collection Practices Act (FDCPA).
If your claim is successful, you could win thousands of dollars in damages.
